1. Acceptance of Terms

By accessing or using gablemed.com (the “Site”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Site.

2. No Medical Advice; No Physician-Patient Relationship

The content on this Site is provided for general informational and educational purposes only. It is not medical advice and is not a substitute for evaluation, diagnosis, or treatment by a qualified health care provider.

Use of this Site, or communication with us by telephone, fax, or email, does not create a physician-patient relationship between you and Gable or any of its providers. A physician-patient relationship is established only upon our acceptance of you as a patient following an evaluation conducted in person or through an authorized telehealth encounter.

Never disregard professional medical advice or delay seeking it because of something you have read on this Site.

3. Emergencies

If you are experiencing a medical emergency, call 911 or go to the nearest emergency department immediately. Signs that require emergency care include, without limitation, rapidly spreading redness or swelling, fever with a wound, uncontrolled bleeding, sudden severe pain, or a wound with a foul odor and drainage. Do not use this Site or email to report an emergency.

4. No Guarantee of Results

Wound healing and hyperbaric oxygen therapy outcomes vary based on the individual patient, the underlying condition, comorbidities, vascular status, nutrition, adherence to the treatment plan, and other factors. Any description of services, therapies, technologies, or results on this Site is illustrative only and is not a promise, warranty, or guarantee of any particular outcome. Individual results will vary.

5. Communications With Us

The Site does not collect information through online forms. Do not send protected health information, photographs of wounds, insurance identification numbers, Social Security numbers, or financial account information by unencrypted email. Email is not necessarily secure or confidential, is not monitored continuously, and may not be reviewed promptly. Use the telephone number listed on the Site for time-sensitive matters.

6. Insurance, Coverage, and Fees

Information on the Site regarding insurance participation, coverage, authorization requirements, or patient cost is general and subject to change. It does not constitute a determination of your benefits or a quotation of charges. Coverage determinations are made by your health plan. See our Good Faith Estimate notice regarding your right to an estimate of expected charges.

7. Intellectual Property

All content on the Site — including text, graphics, photographs, illustrations, page design, logos, and the marks “Gable Wound Care & Hyperbaric Medicine” — is owned by or licensed to Gable and is protected by United States copyright, trademark, and other intellectual property laws. You may view, download, and print Site content for personal, non-commercial reference only. You may not reproduce, republish, distribute, modify, or create derivative works from Site content without our prior written permission.

8. Prohibited Conduct

You agree not to use the Site to violate any law; to attempt to gain unauthorized access to any portion of the Site, our systems, or our patient portal; to introduce malicious code; to scrape or harvest data; to interfere with the operation of the Site; or to impersonate another person.

The Site may link to websites operated by third parties, including our patient portal, health plans, and health information resources. We do not control and are not responsible for the content, accuracy, availability, or privacy practices of those sites. Links do not constitute endorsement.

10. Disclaimer of Warranties

The site and all content are provided “As is” and “As available,” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that content is accurate, complete, or current.

11. Limitation of Liability

To the maximum extent permitted by applicable law, gable and its members, managers, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits or lost data, arising out of or relating to your use of or inability to use the site, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages.

Nothing in these Terms limits or excludes any liability arising from professional health care services actually rendered to a patient, which is governed by applicable law and not by these Terms. Nothing in these Terms limits any liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Gable and its members, managers, officers, employees, contractors, and agents from any claim or demand, including reasonable attorneys’ fees, arising out of your breach of these Terms or your misuse of the Site.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any action arising out of or relating to the Site or these Terms shall be brought exclusively in the state courts located in St. Johns County, Florida, or in the United States District Court for the Middle District of Florida, Jacksonville Division, and you consent to the personal jurisdiction of those courts.

14. Severability

If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.

15. Changes to These Terms

We may revise these Terms at any time by posting a revised version on this page with an updated Effective Date. Your continued use of the Site after revisions take effect constitutes acceptance.
